This Consent to Electronic Delivery of Documents (Consent) applies to the electronic delivery to you of the statements and other documents described in Section 2 (Documents) for the account(s) that you have designated for us through our EasyLine telephone banking service today, and any extension, renewal, amendment and replacement of any of these accounts (Accounts).
We, us and our mean The Toronto-Dominion Bank and its affiliates that provide any of the Accounts. You and Your mean each person providing this Consent.
You consent to the electronic delivery of the Documents as described in Section 2 through our EasyWeb online banking service (Digital Banking Service). You can revoke this Consent at any time, as set out in Section 4.
This Consent takes effect on the day that you agree to it. You may receive additional Documents by paper delivery while we process this Consent. After that you will not receive Documents by paper delivery except as set out in the paragraph below, as set out in Section 2, or until you revoke this Consent.
Mortgages and real estate secured lines of credit: If there are changes to the ownership of any Account that is a mortgage or real estate secured line of credit, your Consent for that Account will be terminated and Documents for that Account will be provided by paper delivery. In addition, if you are a legal entity other than a person or individual, we are unable to provide Documents to you electronically for mortgages and real estate secured lines of credit and we will immediately terminate this Consent for those Accounts.
Joint Accounts: For any chequing or savings Account that is a joint account, or guaranteed investment certificate (GIC), term deposit or education savings plan (RESP) that is a jointly held Account, you are granting this Consent on behalf of the other joint account holder(s). You confirm to us that you have the authority and approval of the other joint account holder(s) to do so. You will inform them of this Consent, including the ability to revoke this Consent for any such joint Account as set out in Section 4.
We may send Documents by paper delivery: It is important to know that we may deliver paper Documents to you even though you have given this Consent. We may do so for any reason, including if we have reason to believe you may not have received the electronic Document or if we otherwise choose to do so. Any Documents we send by paper delivery will be sent to the last mailing address for you that we have in our records. You agree to notify us of any change to your mailing address. Please also note that at the time you are agreeing to this Consent, the only Documents we are able to deliver electronically for mortgages and real estate secured lines of credit are statements.
Account statements and any Documents included with Account statements are accessible for 7 years after they are posted on our Digital Banking Service, and any other Documents are accessible for 6 months after they are posted there, unless you delete them, the Account is closed, or your access to our Digital Banking Service is cancelled or terminated. Availability of Account statements and Documents for savings accounts, GICs, term deposits, tax-free savings accounts (TFSAs), RESPs and retirement savings plans (RSPs) may also be affected if there is account inactivity or a zero balance for a period of time.
Revocation: You may revoke this Consent for any Account. Revocation does not affect any obligations you owe to us.
How to revoke: You may revoke this Consent for any Account by notifying us through our Digital Banking Service, EasyLine telephone banking, or at any branch.
If you revoke: If you revoke this Consent for any Account, we'll send you Documents for that Account by paper delivery to the mailing address that we have in our records for that Account. You may receive additional Documents electronically while we process your revocation. We will confirm your revocation and may do so electronically.
Information not covered by this Consent: We may send you information, documents, and statements that are not included in the description of Documents in Section 2 through any method we choose, including electronically.
Access: You must access our Digital Banking Service to review Documents on a regular basis and at least monthly. You must contact us immediately if your access to our Digital Banking Service has been restricted or denied and you cannot access or view your Documents. A Document is deemed to be delivered to you on the day the Document is posted on our Digital Banking Service and not on the day that you review the Document.
Your hardware and software: You confirm that you have the required hardware and software to access our Digital Banking Service and you acknowledge that those requirements may change from time to time. We do not own or operate any hardware or software you use and we are not responsible for it.
Retaining Documents: You are responsible for ensuring that you can print, store and save Documents delivered to you electronically.
This Consent is in addition to other agreements you have with us for your Accounts. It does not replace them. However, if you have already provided us with consent to electronic delivery of Documents for any Account, this Consent replaces the consent you previously provided to us for that Account.
We may change this Consent from time to time. We will notify you that we are making changes to this Consent by any method permitted by law, including by posting a notice on our website or by electronic or paper delivery of the notice.
This Consent will be governed by and interpreted in accordance with the laws of the province or territory in Canada where you reside and the laws of Canada as applicable. If you do not reside in Canada, this Consent will be governed by and interpreted in accordance with the laws of the Province of Ontario and Canada, as applicable.
It is the express wish of the parties that this Consent and any related documents be drawn up in English. Les parties ont exprimé la volonté expresse que ce Consentement et tous les documents s'y rattachant soient rédigés en anglais.
We are not responsible for any loss you may incur in connection with the electronic delivery of Documents or in connection with any email notification you requested that we send to you.
