Survivor's Financial Plan Terms and Conditions
Underwitten by TD Life Insurance Company under Policy TDL016
What follows is a summary of the Certificate of Insurance. For the full terms and conditions of the Survivor's Financial Plan, please refer to the Certificate of Insurance, which will be sent to you if an application which you have submitted is accepted by TD Life Insurance Company, a member of TD Bank Financial Group. In the event of a conflict, the Certificate of Insurance will govern.
Definitions
Capitalized terms shall refer to the following definitions:
Cancer (Life-Threatening) means a diagnosis 90 days after the effective date, of a tumour characterized by the uncontrolled growth and spread of malignant cells, but does not include carcinoma in situ, malignant melanoma to a depth of 0.75 mm or less, any skin cancer that has not spread beyond the deepest layer of the skin, stage A prostate cancer* and Kaposi's sarcoma.
No cancer diagnosed in the first 90 days of coverage is covered.
Critical Illness means Cancer (Life-Threatening), Heart Attack, or Stroke, as defined in the Certificate of Insurance and as quoted in this page.
Evidence of Insurability means written proof that a person meets our medical underwriting requirements.
Acute Heart Attack means the death of a portion of your heart muscle resulting from inadequate blood supply for which the following test results are confirmed:
- an increase of cardiac bio-markers and/or enzymes found in the blood stream, as a result of damaged heart muscle tissue, to levels considered diagnostic for an acute myocardial infarction.
Diagnosis of the Acute Heart Attack must be made by a physician qualified to make the Diagnosis.
Acute Heart Attack does not include an:
-
incidental finding of ECG changes suggesting a prior myocardial infarction with no corroborating event; or
- increase of cardiac bio-markers and/or enzymes due to coronary angioplasty (a medical procedure involving the ballooning of a narrowed coronary artery) unless there are new elevations of ST segments in the involved ECG leads considered diagnostic for an acute myocardial infarction; or
-
increase of cardiac bio-markers and/or enzymes in the blood stream due to pericarditis or myocarditis.
Insured Person means the customer of TD Bank Financial Group set out on the face page of the Certificate.
Physician means a qualified doctor, licensed and practising medicine in Canada.
Policy means Group Insurance Policy #TDL016 issued by TD Life to The Toronto-Dominion Bank.
Stroke means a cerebrovascular event producing neurological sequelae lasting more than 30 days and caused by thrombosis, hemorrhage, or embolism from an extra-cranial source. There must be evidence of measurable, objective neurological deficit. Transient Ischemic Attacks are not covered.
Premiums
Premiums will be collected monthly via direct debit from your bank account or credit card. The first premium due date will be the monthly anniversary day following the Effective Date of Coverage. Each subsequent premium due date will follow one calendar month later.
The premiums as indicated in the Table of Benefits are due monthly. Upon 30 days' prior written notice, TD Life has the right to change the premium rates applicable to all Certificate holders under the Policy.
The amount of monthly premium payable on a premium due date is in accordance with the premium as shown in the Table of Benefits. In the event of 25% of the Face Amount benefit being paid under a Prostate A claim, the premium will not be reduced and will continue subject to this Certificate remaining in force.
Benefit Provisions
Critical Illness - A benefit equal to the Face Amount shown in the Table of Benefits (with the exception of Stage A prostate cancer which will have a benefit equal to 25% of the Face Amount shown in the Table of Benefits) shall be payable to the Insured Person provided that this Certificate is in force and -
- the Insured Person is first diagnosed by a Physician as suffering from either a Heart Attack or Stroke after the Effective Date of Coverage; or
- the Insured Person is first diagnosed by a Physician as suffering from a Cancer (Life-Threatening) 90 days or more after the Effective Date of Coverage.
The Insured Person must survive 30 days after the date on which the Critical Illness was first diagnosed.
Death Benefit - A benefit equal to the Face Amount shown in the Table of Benefits shall be payable to the Beneficiary (or estate if no beneficiary is designated) upon death of the Insured Person provided that -
- the Certificate is in force at the time of death of the Insured Person; and
- the Insured Person had not attained the age of 70 years prior to death.
A reduced benefit of 75% of the Face Amount shall be payable in the event that the Insured Person has previously had a claim paid for Stage A prostate cancer.
General - All benefit payments are subject to the satisfaction of all provisions of the entire contract.
Exclusions and Limitations
No benefit for Cancer will be available if the earlier of:
- the date of diagnosis; or
- the date of symptoms and/or medical consultations that led to diagnosis
occurs within the first 90 days following the Effective Date of Coverage (or 90 days from the Effective Date of last Reinstatement). If Cancer is diagnosed within the first 90 days following the Effective Date of Coverage or Reinstatement, all insurance associated with the Insured Person's coverage will terminate and all associated premiums paid will be refunded.
No Critical Illness Benefit will be paid for claims incurred as a result of the use of illegal or illicit drugs or substances, or misuse of medication obtained with or without prescription. In that event, all premiums associated with the coverage on the life of the Insured Person shall be refunded.
No Death Benefit will be paid for intentionally self-inflicted injuries or suicide, while sane or insane, if the insurance has been in force for less than two years. In that event, all premiums associated with coverage of the Insured Person shall be refunded.
Only natural persons shall be issued Certificates.
No benefit will be paid for Cancer (Life-Threatening), Heart Attack or Stroke or death of the Insured Person that is caused directly or indirectly by a Pre-existing Condition.
No benefit will be paid for a Critical Illness diagnosed before the Effective Date of Coverage.
No benefit will be paid for a Critical Illness when one of the other Critical Illnesses exists before the effective date of coverage.
Pre-existing Condition
A Pre-existing Condition is an illness or condition for which the insured has received medical consultation, treatment, care, services or has been prescribed medication during the 24 months immediately preceding the effective date of the insurance coverage.
Statements of an Insured
If an Insured Person fails to make full, complete and truthful disclosure in response to questions during the enrollment process (on the Application on the telephone, Internet or on paper) and on any other documents submitted as evidence of insurability, and if an Insured Person fails to tell TD Life every fact material to his/her insurance, the insurance under this Certificate is voidable at TD Life's option.
Statements made in an Insured Person's Application Form or during the Application process on the telephone or on the Internet, or in any evidence of insurability form such as supplementary applications, that are fraudulent may be contested at any time. Other statements are incontestable two years after the statements are made.
If the age, date of birth or gender of an Insured Person is found to be incorrectly stated on his/her Application Form such that he/she was not eligible for insurance, no insurance will be provided and any premiums associated with the Insured Person's coverage shall be refunded. If he/she remains eligible, the amount of benefit payable will be determined based on the Insured Person's actual age, date of birth and gender.
If the smoking status of the Insured Person has been misstated, the insurance on the life of the Insured Person will be voidable by TD Life. If such misstatement comes to our attention, then the insurance shall be voided.
Termination of Coverage
The insurance of an Insured Person will terminate on the earliest of the following dates -
- the date TD Life receives an Insured Person's written notice of termination of coverage;
- the date a Premium remains due but unpaid for 30 days;
- the date the Group Policy is terminated, of which the Insured Person will receive at least 30 days' advance written notice;
- the date the Insured Person attains the age of 70;
- the date you are entitled to have a Critical Illness Benefit or Death Benefit paid, except where 25% of the Face Amount is paid for Stage A prostate cancer. In the event of a claim for Stage A prostate cancer, 75% of the Face Amount will remain in effect in the event that a subsequent claim is made, whether the subsequent claim is for Stage B prostate cancer or one of the other covered critical illnesses or for death;
- Cancer diagnosed less than 90 days after the Effective Date of Coverage.
